Opening statements revealed the stark differences in each side’s narrative. The plaintiff’s attorney took aim against Johnson & Johnson, alleging the use of misleading tactics in research practices and throughout the litigation procedure. According to the attorney the company attempted to manipulate asbestos’ definition, in spite of internal documents from the year 1978 and 1994 indicating that fibers discovered in the plaintiff’s tissue are included.
Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance as we progress of this trial. Asbestos containing talc chem formula. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States was appointed as the claims representative in the initial bankruptcy. J&J’s defense team wants Ellis to be appointed in that position and again, but attorneys for the talc plaintiffs are objecting to the claim that Ellis has an interest conflict which would prohibit her from being appointed to that post again. The issue stems from the possibility that Ellis was apparently involved in the creation of the hotly contested second bankruptcy, which raises questions regarding her capacity to remain neutral. In reality, this bankruptcy is likely to be dismissed regardless.
May 17, 2023 Update: The pretend company J&J created to handle the bankruptcy of talc informed a New Jersey bankruptcy court that they have designated $400 million as a settlement for allegations made by states who accuse J&J of misleading marketing for its talc-based products. It is hard to imagine any scenario in which J&J can get the settlements of baby powder through at these numbers. While J&J’s $8.5 billion offer may seem like a large sum initially, it will not appear appealing when you look at the numbers. This settlement proposal – by our rough calculations – would not be able to pay victims more than an average settlement $100,000 per instance. This isn’t enough.

Asbestos containing talc chem formula. The committee also requested that the halted tort litigation against J&J continue to proceed.
LTL has filed for Chapter 11 protection once again after its first bankruptcy filing was denied in the Third Circuit earlier this year with an $8.9 billion payment. The committee argues that the recent ruling, which allows LTL’s third Chapter 11 to continue, in addition to halting trials against J&J should be subject to the immediate Third Circuit review. The US Trustee also asked that it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a formal response to the appeals court calling the request an “desperate and legally deficient attempt” by a small number of law firms with different financial interests.
May 1 2023 Update: A common question that people ask is how could plaintiffs and their attorneys turn down $8.9 billion. Of course, that’s an immense amount of money. But there are a lot of victims. Asbestos containing talc chem formula. These are an excellent claims for plaintiffs. We have been reminded of this recently in two talc trials which have resulted in huge verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon was settled with an award worth $18.1 million. A month later, another talc mesothelioma case went to trial on the other side of South Carolina and resulted in a verdict of $29million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. one of the leading suppliers of talc within the U.S.
April 30 2023 Update: When J&J initially attempted to pull the talcum powder litigation into bankruptcy, they came with an offer to put aside $2 billion for settlements. The sum was ridiculously low. There was no one among the talc victims who were in favor of it. This time around, however, J&J has increased the offer to $8.9 in the event that the talc victims will allow a bankruptcy settlement and they also have the backing of a significant section of the talc victims as well as their lawyers. Asbestos containing talc chem formula. But with 75% of plaintiffs who are a talc, which is necessary for bankruptcy plan approval, it a tough road with so many lawyers with vast inventory of baby powder lawsuits opposed to the settlement.
What can be done to end the impasse? More billions.
April 25, 2023 Update: Talc Cancer victims have demanded a judge reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Asbestos containing talc chem formula. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not a candidate for bankruptcy relief since it did not show financial difficulties.
The claimants argue that the second Chapter 11 case is an overreach of the bankruptcy system and it’s being pursued in bad faith. J&J states that the bankruptcy settlement is backed by “significant backing” from the firms that represent around 60,000 plaintiffs. It is fair to say that the plaintiffs’ attorneys and victims are divided over what they believe is an $8.9 billion settlement offer.
April 21st, 2023 Update: A bankruptcy judge has decided the company Johnson & Johnson must face new lawsuits claiming that the company sold baby powder that was contaminated and causing cancer. Judges expressed skepticism about J&J’s ridiculous effort to relaunch its strategy in the second bankruptcy case.
April 13th, 2023 update: the most important announcement is an $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer victims involved in the MDL collective action pledged to fight the settlement alongside the talc claimants. Why? They think it is not enough money for more than 70,000 cancer victims. Asbestos containing talc chem formula. The lawyers say that J&J could negotiate a greater settlement or litigate individuals’ claims if the current bankruptcy is thrown out.
But there’s a separate group of lawyers that is not part of the top leadership in the class action. These lawyers have amassed many thousands of cases. This group wants to settle the case now for what many argue is far less than what these victims deserve. Their argument is two-fold. The first is that they claim the settlement of around 100,000 dollars per plaintiff – is fair.
This is an argument that is difficult to present. The second argument is more force: the victims can not afford to wait any longer and need to get their money right now.
April 12 2023 Update: Many are asking how J&J can go through bankruptcy once more. The answer is complex and convoluted. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future lawsuits involving talc conclusively. In other words, it believes that it will be less expensive should there be a bankruptcy component that applies pressure for a settlement. Asbestos containing talc chem formula. Going back to the 400-year span of American past, the company argues that bankruptcy benefits all parties because it distributes settlements more fairly and effectively than trial courts, in which some litigants receive substantial settlements while others get nothing.
The gist in the 3rd Circuit decision was this isn’t a case that involves a profitable company making an affiliate to accept the legal risk and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. However, it also stated it was not in financial crisis due to the fact that J&J promised unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding aspect of the holding and didn’t promise to fund unlimited the litigation. The company says that its modified financing arrangements with its subsidiary addresses the concerns of the appellate court, while offering funds to pay claims. In the hope that offering victims less money will solve the overall issue.
Lawyers representing cancer patients who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the largest “fraudulent deal ever in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023, Update Bloomberg provides an insightful piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a share of any settlements. J&J is now willing to pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public knowledge because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to respond to the increasing calls for regulation of the litigation funders. J&J has more than 60,000 claims when you combine federal and state infant powder litigation. Third-party funding of mass tort cases has pros and pros and. But there is no question that we are seeing the ways that third-party funding can even the playing field between people and large corporations in the courtroom.
April 4, 2023 Update: It is fun to watch the worm turning in this litigation. J&J has taken another blow this week when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals an appeal at the U.S. Supreme Court. It has frozen thousands of talcum cases and stopped new lawsuits from arising ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt entity over a year ago. Asbestos containing talc chem formula. After the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was removed. J&J had hoped to have it remain in effect until its SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that for the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay being officially lifted, the first new cases were filed and incorporated into the talcum powder class action MDL in just over a year. Seven new talc lawsuits were brought into the MDL in the last month, bringing the total number of cases that are pending to 37,522.
February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J Talc products have cost the government in the years.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc-based products for many years, while tax dollars were used to treat those who were injured through exposure to the product. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Asbestos containing talc chem formula. J&J has to begin making reasonable settlement proposals to victims to getting this behind. This is a blemish on one of the world’s greatest companies.
