April 25, 2023 Update Talc plaintiffs have asked a judge to disqualify the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. There is a different lawyer group that isn’t part of the leadership in group action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle today for what is believed to be less than the victims deserve. The argument they make is two-fold. They argue that the settlement – which amounts to an average of $100,000 per plaintiff – is fair.
This argument isn’t easy to prove. But their second argument has more force: the victims can now not wait and they want their money today.

Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc litigations in a definitive manner. That is, it thinks it can get a lower rate should there be the bankruptcy element which applies pressure to negotiate a settlement. Asbestos testing in talc. Moving past more than 400 years in American history, the firm claims that bankruptcy benefits all parties as it distributes settlement payments more evenly and more efficiently than trial courts which are where litigants get significant awards while others receive nothing.
The main thrust of this 3rd Circuit decision was this is not a case of one that makes a profit, but subsidiaries to meet the legal liability and declare bankruptcy, which is what Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified the company was financially difficulty because J&J promises unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding portion of the holding but did not pledge to fund unlimited lawsuits. The company claims that revised financing arrangements with its subsidiary will address appeals court’s concerns while still offering claim payment funds. It’s as if giving victims lower amounts of money would resolve the underlying issue.
Attorneys representing cancer patients who are against the agreement argue this by arguing that the plaintiff is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared the lawyers representing victims call it the biggest “fraudulent move ever in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. But it is a way to try and push the $8.9 billion settlement and keep the pressure on plaintiffs.
April 10 2023 Update Bloomberg is running an intriguing report on a brand new law within New Jersey that is shedding new light on litigation funding in the suit for class actions. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange for a share of any settlements. J&J is now willing that it will pay $8.9 billion in settlements for all lawsuits.
The involvement of funders is publicly available because of a New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to tackle the growing demands for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include federal and state infant powder litigation. Third-party financing in mass tort cases is not without its pros and cons. There is no doubt that we are witnessing the ways that third-party funding can even the playing field between individuals and big corporations in court.
April 4, 2023 Update: It is enjoyable to see the worm turning in this litigation. J&J suffered another setback this week, when they were denied by the Third Circuit denied J&J’s request to extend the automatic stay in the meantime that J&J appeals an appeal to the U.S. Supreme Court.
