New Mexico and Mississippi had already brought actions for damages against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued subpoenas or civil investigative demands according to court documents.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished in a joint move with cancer victims and the U.S. Justice Department’s watchdog on bankruptcy, who have claimed that a lucrative company such as J&J cannot benefit from bankruptcy protections aimed at the struggling debtors.
The first attempt by LTL to resolve the bankruptcy-related lawsuits was dismissed after similar arguments. The U.S. appeals court determined the LTL was not in “financial distress” and was not eligible under bankruptcy law. Is baby powder talc free now. LTL made a new bankruptcy application less than two hours after the dismissal, arguing the second bankruptcy was different in that there was less money available and had a greater chance of securing a settlement.

New Mexico and Mississippi said in their motion to dismiss that LTL’s bankruptcy renewal violates the law enforcement powers of the state in attempting to unilaterally limit LTL’s liability to state consumer protection actions.

LTL’s recent filings also provided more information on how the company would evaluate and settle cancer claims when the bankruptcy plan is approved.

The highest payments under the settlement will be $500,000 for patients diagnosed with mesothelioma terminal prior to age 45. Is baby powder talc free now. The second payment would be $260,000 for patients diagnosed with terminal ovarian cancer prior to age 45.

From there, the proposed settlement will offer discounts based on the kind and severity of cancer, an individual’s age, history of usage of talc and other variables. Is baby powder talc free now. Judge gives order to J&J and talc opponents to engage in settlement talks.

After another round of hearings in Johnson &Johnson’s attempt to utilize a Texas Two-Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the company and those opposed to the strategy to engage in talks to reach a settlement, Bloomberg reports.

With its second bankruptcy bid for LTL Management, a subsidiary created by J&J to hold the claims–the company made a settlement offer of $8.9 billion. Is baby powder talc free now. While one group of law firms representing plaintiffs agree with the settlement, a different group opposes the deal.

Earlier this week, the opposition group, known as the Official Committee of Talc Claimants in the bankruptcy court, demanded to dismiss this case arguing that LTL is not considered to be in financial distress.

“The filing is a desperate and legally ineffective attempt by a tiny number of law firms to block claimants from voting on the resolution, which that the vast majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Is baby powder talc free now. “The law firms that are behind these filings have interests in finance that are in conflict with, diverge from, and contravene those that their customers. We’ll be submitting a response an appeal to the appellate court.”

“J&J publishes press release describing how fantastic the plan is but simultaneously insisting that the details of its plan–including the treatment individuals with illnesses would receive,” Thompson said in the statement. “What do J&J have to conceal?”

Kaplan has commanded the parties to develop a new restructuring plan, with the supervision of two mediators.

On February 20, 2022 Kaplan affirmed the ability of J&J’s use of Chapter 11 to hasten a settlement that would free the company from the tens of thousands of claims regarding its talcum products.

In January of this year, a federal appeals court overturned the verdict, ruling that the business could not be considered to be in “financial financial distress.”

In the event that J&J’s request to contest the U.S. Supreme Court was denied at the end of April J&J declared bankruptcy about two hours after. In response, Kaplan froze the lawsuits for 60 days in order to determine whether to allow to file for bankruptcy again.

With Two Chapter 11 attempts, J&J has purchased 19 months of which cases have been on hold. Is baby powder talc free now. The company wants claimants to accept their settlement. J&J requires 75% of the vote in order for the agreement to be accepted.

In addition to the gang of talc lawyers that criticized LTL’s bankruptcy plan as well, the U.S. Trustee which is a division that is part of the U.S. Department of Justice is also submitting an application to dismiss LTL’s second bankruptcy case.

In a statement this week, U.S. Trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest, but naive debtors.” Those doors “are not accessible to those that don’t have a legitimate bankruptcy objective or seek to abuse the bankruptcy process to delay or hinder their creditors,” Vara continued.

On the other hand, J&J maintains there is no conclusive evidence that its Talc products, which includes its iconic baby powder, cause cancer. J&J has adopted the products of the market, first in North America in 2020–and the rest of the world this year.

J&J intends to steer clear of the expense of going to court. It has prevailed in the majority of cases that were decided during trial, however, some losses have been punitive.
A highly-publicized trial in Missouri resulted in an $4.7 billion verdict against the drug company and was later lowered to $2.1 billion after appeals.

In all, J&J has lost nine trial involving talc that are being appealed or resolved. Of the 41 trials, 32 have resulted in the favor of J&J either through a mistrial or plaintiff verdicts that were dismissed in appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Baby Powder Talc Free Now

June 2 2023 Update: At the trial for asbestos-containing talc at the trial in California yesterday, a couple of technical issues interrupted the opening statement by the defense attorneys. Is baby powder talc free now. Jurors from home on Zoom but did not hear Johnson & Johnson’s lawyer voice his doubt about the science of the 70s asserting the presence of asbestos in their product prior to the proceedings abruptly ended.

Meanwhile, the plaintiff was able to present their first witness, Arthur Langer. Langer explained that the existence of additional minerals along with talc is inevitable. He claimed that his group had notified J&J in 1971 of the presence of asbestos chrysotile in the talc produced by the company, although with lower than 0.1 percent. The asbestos was discovered by him in 1976.

June 1st, 2023 Update: Is baby powder talc free now. The first trial since J&J decided to spin off its Talc section and declaring bankruptcy marks an important moment for the ongoing lawsuit story. Trial started on Monday in the heartbreaking case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma in the past year, an illness that lawyers on both sides believe is a harrowing tragedy.

Opening statements revealed stark differences in each side’s narrative. The attorney representing the plaintiff took aim towards Johnson & Johnson, alleging the use of deceptive tactics in research practices and throughout the litigation procedure. As per the lawyer the company attempted to manipulate the definition of asbestos despite internal documents dating back to the year 1978 and 1994 indicating that asbestos fibers found in tissue of the plaintiffs are included.

Johnson & Johnson’s precarious $8.9 billion settlement proposal hangs in the balance as we course of this trial. Despite the unique nature of this mesothelioma case and its distinctive issues in comparison to other lawsuits involving talcum powder and a decision in favor of the plaintiff could be an unintended setback to Johnson & J’s hope of gaining broad acceptance for their proposed settlement among plaintiffs.

May 31st, 2023 Update: Johnson & Johnson’s bankrupted talc unit has vigorously defended it’s 2nd Chapter 11 filing in the opposition of talc injury claimants. In an appeal to the New Jersey bankruptcy court, it argued that the situation was distinct from the previous filing. It highlighted the extraordinary commitment to $8.9 billion by J&J the largest ever settlement in a mass tort bankruptcy case. Is baby powder talc free now. There was no mention of how the magnitude of the settlement means it is a fair settlement. J&J also claimed that it received support from various plaintiffs’ law firms representing over sixty thousand claimants. This is hard to verify but likely incorrect.

May 24, 2023 Update: Since Johnson and Johnson’s bankruptcy filing in 2021 filing, the first trial involving its cosmetic talc products allegedly containing asbestos is set to begin jury selection on Monday in California at Alameda County Superior Court, the most favored place for plaintiffs. The plaintiff asserts that his mesothelioma resulted from asbestos exposure in J&J’s product which that the company has denied. The trial also includes six retailers who are accused of selling talc-containing products.

May 22, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are fighting over who should be appointed to the role of future claims representative. This is the role is crucially critical to resolving Talc claims. Is baby powder talc free now. Randi Ellis, a lawyer who regularly appears in MDLs across the country was appointed the claims representative during the first bankruptcy. J&J’s defense team would like Ellis to be appointed to that role again, but lawyers for the talc plaintiffs are objecting because Ellis has a conflict of interest that would prevent her from holding that position again. This conflict is rooted in the possibility that Ellis was apparently involved in the creation of the hotly disputable second bankruptcy, which raises doubts regarding her capacity to remain neutral. However, the reality is that this bankruptcy is likely to be tossed out anyway.

May 17, 2023 Update: The fake company J&J made up to handle the bankruptcy of talc told the New Jersey bankruptcy court that they have designated $400 million to settle the claims brought by states accusing the company of deceitful advertising for its talc-based products. Is baby powder talc free now. That’s an $8.5 billion settlement for cancer sufferers. It is hard to imagine the scenario in which J&J could push the settlements of baby powder through with these numbers. Although J&J’s $8.5 billion offer might seem like a lot of money at first, it does not look good after you calculate the figures. This settlement offer based on our rough calculations would not provide victims with much more than an average settlement $100,000 per case. It’s not enough.

May 15th, 2023 Update J&J could be facing lawsuit brought by an advocacy group representing cancer victims. Is baby powder talc free now. The group contends that J&J deliberately retracted a $61.5 billion financing agreement together with its parent company, LTL Management LLC, to simulate financial stress and verify the unit’s Chapter 11 bankruptcy filing. The group argues that this act is equivalent to a fraudulent transfer of rights of compensation for victims. They intend to investigate J&J’s actions as a result of the dismissal of the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: During the next week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to reject the second bankruptcy filing of J&J company LTL Management. However, in the meantime LTL Management has filed an order calling for both parties to take part in a settlement mediation with the hopes of achieving the global settlement can be brokered.

May 5th 2023 Update: The talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products caused cancer through asbestos exposure. Is baby powder talc free now. Over 2700 people have sued the firm and it is paying $1 million per month for legal defense. The company’s recent $29 million settlement at the Supreme Court of South Carolina forced it to file for bankruptcy protection, arguing for an equitable distribution of assets between the claimants of talc instead of being taken from the receiver. Other talc suppliers have also filed for bankruptcy due to legal proceedings.

May 4, 2023 update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to restart settlement discussions with lawyers who rebuffed Johnson & Johnson’s $8.9 billion settlement offer. It was in Trenton, New Jersey yesterday the parties appeared in court to discuss next steps to take in their second bankruptcy matter and Judge Kaplan was pushing for more settlement discussions.

This is the answer to settle these claims for J&J. A baby powder settlement could be completed. Is baby powder talc free now. But it will require more money, more billions of dollars – of Johnson & Johnson.

Lawyers are split on whether or not to agree with the proposal and not every client views the issue the same way their lawyer views it. Second bankruptcy cases are likely to be a failure the judge Kaplan has scheduled a hearing for June to decide whether to dismiss the bankruptcy for the second time.

May 3, 2023 Update A group of cancer victims suing Johnson & Johnson (J&J) demanded for J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. The group representing the claimants filed a motion on Tuesday, asking the Third Circuit to consider their case and to send it back an earlier court with instructions to dismiss the bankruptcy. Is baby powder talc free now. They also asked that the stopped tort litigation against J&J allow the litigation to continue.
LTL requested Chapter 11 protection once again after its first bankruptcy filing was denied by the Third Circuit earlier this year and offered a $8.9 billion settlement. The committee says that the recent ruling which allowed LTL’s third Chapter 11 to continue, while also halting trials against J&J and J&J, requires immediate Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation Erik Haas, was quoted by Bloomberg saying that J&J plans to file a reply in the appeals court, declaring the filing an “desperate and legally deficient effort” by a handful of law firms with competing financial interests.
May 1st 2023 Update: A question people keep asking is how plaintiffs and their attorneys turn down $8.9 billion. Of course, it’s a lot of money. But there are plenty of victims. Is baby powder talc free now. These are an excellent arguments for plaintiffs. We were reminded of this recently in two talc trials which ended in large verdicts for plaintiffs. In February, a talcum powder mesothelioma trial in Oregon resulted in the verdict that was $18.1 million. In the same month, a different mesothelioma-related talc case went to hearing at South Carolina and resulted in the verdict of $29 million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. One of the most prominent suppliers of talc within the U.S.
April 30, 2023 Update: When J&J initially tried to take the talcum powder lawsuit into bankruptcy, it came with the option of putting aside $2 billion to settle the case. It was a ridiculously small amount. There was no one among the talc victims who were in favor of it. This time, J&J has increased the offer to $8.9 If the talc plaintiffs will allow a bankruptcy settlement and they have the backing of a significant section of the talc victims as well as their lawyers. Is baby powder talc free now. But with 75% of talc plaintiffs, which is necessary for bankruptcy plan approval is not an easy task with so many lawyers with large inventories of baby powder lawsuits that are opposed against the proposed settlement.

What are the solutions to the impasse? More billions.
April 25 2023, Update Talc patients have demanded a judge dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Is baby powder talc free now. It was the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible for bankruptcy relief since it had not demonstrated financial stress.

The claimants contend that LTL’s Second Chapter 11 case is an abuse of the bankruptcy system and that it’s being pursued in bad faith. J&J says the bankruptcy settlement has “significant support” from firms representing around 60,000 claimants. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on the $8.9 billion amount of settlement offered.

April 21st, 2023 Update: A bankruptcy judge decided in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Even though trials for the talc lawsuits have been suspended for at least 60 days and new lawsuits are able to be filed and lawyers are able to begin preparing their cases. Is baby powder talc free now. The judge expressed skepticism over J&J’s attempt to relaunch its strategy in a second bankruptcy case.

April 13th, 2023 Update: biggest story is that there’s an $8.9 billion over 25 year period settlement offered. Lawyers representing cancer victims who are part of the MDL Class Action have pledged to fight the settlement along with the talc claimants. Why? They argue that it’s not enough for 70,000 victims who have cancer. Is baby powder talc free now. These lawyers argue that J&J should negotiate a bigger settlement or pursue individual claims if the most recent bankruptcy is thrown out.

But there is another group of lawyers outside of the top leadership in the class action. These lawyers have collectively amassed tens of thousands of cases. The group is seeking to settle now for what many argue is far less than what these victims deserve. The argument they make is twofold. First, they argue that the settlement – which amounts to the equivalent of $100,000 per plaintiff – is fair.

This argument isn’t easy to prove. But their second argument has more force: victims should no longer wait and want the money immediately.

April 12, 2023 Update: People are wondering if J&J is able to file for bankruptcy again. The answer is complex and complex. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc lawsuits conclusively. That is, it thinks it can get a lower rate in the event of a bankruptcy component that applies pressure to negotiate a settlement. Is baby powder talc free now. In a quest to cover hundreds of years of American past, the company asserts that bankruptcy benefits everyone by dispersing settlement payments more equitably and effectively than trial courts which are where litigants get significant settlements while others get nothing.

The main thrust in this 3rd Circuit decision was this is not a case – the profit-making company that has an affiliate to accept the legal liability and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. However, it also stated that the subsidiary was not financially distress because J&J offered unlimited financing.
So J&J took advantage of the funding unlimited part of the agreement but did not pledge that it would provide unlimited funds for lawsuits. The company claims that its updated financing arrangements with its subsidiary will address appeals court’s concerns while still offering funds to pay claims. It’s as if giving victims lesser money could solve the problem at hand.

Lawyers representing cancer victims who oppose the deal counter this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared: victims’ lawyers call this the biggest “fraudulent transfer of assets in United States history.”

Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way of pushing this $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10 2023 update: Bloomberg provides an insightful article about a new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a percentage of any winnings. J&J is now offering that it will pay $8.9 billion to settle all lawsuits.

The funders’ involvement is public information due to an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to tackle the growing demands for the regulation of litigation funders. J&J has more than 60,000 claims when you combine federal and state infant powder litigation. Third-party funding of mass tort cases is not without its pros and cons. However, there is no doubt that we are witnessing how third-party financing can help level the playing field between individual as well as large corporations in the courtroom.

April 4 2023 Update: It is enjoyable to see the worm turn in this lawsuit. J&J suffered another setback this week when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. This automatic stay stopped thousands of talcum powder cases and stopped any new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt subsidiary more than one year ago. Is baby powder talc free now. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was lifted. J&J wanted to see it continued pending hearing the SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL within a year. Seven new talc cases were brought into the MDL in the last month which brings the total number of cases in the pending process up to 37,522.

February 25, 2023 Update This morning, a Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J products containing talc have cost the government in the many years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc-based products for years while tax dollars were utilized to treat people injured by exposure to the product. The suit comes just a few days following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Is baby powder talc free now. J&J needs to start making reasonable settlement offers for victims in order getting this behind. It is a stain on one of the greatest businesses.

February 14 2023 Update: During a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
