The company is trying for another time to settle more than 38,000 lawsuits brought in bankruptcy, as well as prevent new lawsuits from being filed in the near future.
The bankruptcy plan of LTL would pay $400 million into a separate trust for claims brought from state attorney generals claiming that J&J did not comply with laws against unfair business practices in the State of New York as well as consumer protection laws by misinforming consumers regarding the quality of its talc products.

A number of states had already initiated consumer protection cases against J&J prior to the time that LTL’s bankruptcy filing stopped these investigations from progressing in 2021. Is Johnson and Johnson talc free. New Mexico and Mississippi had already filed suit against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas, according to LTL’s court documents.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy along with cancer sufferers as well as The U.S. Justice Department’s bankruptcy watchdog, who argue that a profit-making firm like J&J can’t benefit from bankruptcy protections intended for the struggling debtors.
LTL’s first attempt at resolving the lawsuits in bankruptcy was rejected after the same arguments. In the end, a U.S. appeals court determined in favor of LTL did not have “financial difficulty” and ineligible for bankruptcy protection. Is Johnson and Johnson talc free. LTL declared bankruptcy a second time just over two hours after the dismissal, arguing the second bankruptcy was different in that it had less money available and more backing for the settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s bankruptcy renewal violates state law enforcement powers by seeking to unilaterally limit the liability of the company for state consumer protection measures.

LTL’s recent filings also provided more information on how the company would evaluate and settle cancer claims if the bankruptcy plan is approved.

The largest amount of money under the settlement will be $500,000 to those diagnosed with terminal mesothelioma before age 45 and $260,000 for those who have been diagnosed with advanced ovarian cancer prior to age 45.

The proposed settlement will offer discounts based on the type and severity of cancer, the individual’s years of age, their history of usage of talc and other variables. Is Johnson and Johnson talc free. For example the case of a woman who used the talc product on a regular basis, had a family history of ovarian cancer and was diagnosed with the stage 2 ovarian cancer at the age of 55 may qualify for a $21,125 payment under the settlement plan.

Judge decides J&J and talc opponents participate in settlement talks.

After another round of hearings in Johnson & Johnson’s effort to implement a Texas Two-Step bankruptcy strategy to settle talc lawsuits, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposed to the move to conduct settlement talks, Bloomberg reports.

With its second bankruptcy attempt for LTL management, a subsidiary founded by J&J to handle the claims company made a settlement offer of $8.9 billion. Is Johnson and Johnson talc free. While one firm representing plaintiffs is in favor of the deal, another group is against the settlement.

Earlier this week, the opposition group, called”the Official Committee of Talc Claimants and urging the bankruptcy court to dismiss the case by saying that LTL is not a factor in financial distress.

“The filing is a desperate and legally ineffective attempt by a few of law firms to try to stop claimants from deciding on the resolution plan, a plan that the vast majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. Is Johnson and Johnson talc free. “The law firms that are behind this filing have financial interests that clash with, diverge from and contravene those which their clientele. We’ll soon submit an answer an appeal to the appellate court.”

Is Johnson and Johnson talc free. Clay Thompson, a lawyer for MRHFM who has more than 80 patients with mesothelioma who have filed lawsuits against J&J and J&J, has said that the company’s second bankruptcy try will fail.

“J&J issue press releases that boast about how amazing its plan is while simultaneously insisting that the details of its plan–including the treatment each sick person will receive — be kept private,” Thompson said in the statement. “What do J&J have to conceal?”

Kaplan has instructed both sides to create a reorganization plan, under supervision by two mediators.

On February 20, 2022 Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that would release the company from the thousands of lawsuits regarding its talcum products.

In the month of January, a federal appeals court overturned the ruling, ruling that the company could not be considered in “financial trouble.”

The J&J’s plan to contest the U.S. Supreme Court was rejected on April 1, J&J declared bankruptcy about two hours after. In response, Kaplan froze the lawsuits for 60 calendar days to decide whether or not to approve another bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B the talc litigation cost.

In the 2 Chapter 11 attempts, J&J has purchased 19 months of which cases were put suspended. Is Johnson and Johnson talc free. The company would like claimants to accept their settlement. J&J needs 75% approval for the settlement to be approved.

In addition to the group of talc lawyers that criticized LTL’s bankruptcy plan as well, the U.S. Trustee, a branch belonging to the U.S. Department of Justice was also the one to file an application to dismiss LTL’s second bankruptcy.

In a filing this week, U.S. Trustee Andrew R. Vara wrote that the doors of the bankruptcy court remain “open to honest but unfortunate debtors.” The doors “are not accessible to those that lack a legitimate bankruptcy objective or seek to use the bankruptcy process to hinder or delay their creditors.” Vara continued.

On the other hand, J&J maintains there is no evidence conclusive that its Talc products, which includes its iconic baby powder, cause cancer. J&J has taken its products off from the market and will first launch them for North America in 2020–and the remainder of the globe later this year.

J&J is determined to stay clear of the costly business of going to trial. The company has won the majority of cases that have been decided through trial, though some losses have been harsh.
A highly-publicized trial in Missouri led to an $4.7 billion verdict against the drugmaker but was later reduced to $2.1 billion following appeals.

In all, J&J has lost nine trial involving talc that are appealing or settled. Out of 41 trials, 32 ended with a win by J&J or a mistrial, or verdict for a plaintiff that was reversed in appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Johnson And Johnson Talc Free

June 2 2023 Update: At the asbestos talc case which took place in California yesterday, some technical issues disrupted the opening statements made by defense lawyers. Is Johnson and Johnson talc free. Jurors who were watching at home via Zoom, did hear Johnson & Johnson’s lawyer expressing doubt about the science of the 70s affirming the presence of asbestos in their product before the session abruptly ended.

The plaintiff could introduce their first witness, Arthur Langer. Langer said that the presence of additional minerals along with talc is expected. He also testified that his team had notified J&J in the year 1971 about the presence of chrysotile asbestos within the talc of the company, but at lesser than 0.1 percent. He also found more asbestos in the year 1976.

June 1, 2023 Update: Is Johnson and Johnson talc free. First trial after J&J has decided to separate its Talc section and declaring bankruptcy marks an important moment of the ongoing lawsuit controversy. Trial began yesterday in the tragic trial of a young plaintiff, diagnosed with an extremely rare and aggressive form of mesothelioma last year. which both sides acknowledge is a harrowing tragedy.

Opening statements revealed the sharp differences in the two sides’ story. The attorney representing the plaintiff aimed his ire against Johnson & Johnson, alleging the use of misleading methods in their research practices as well as throughout the litigation procedure. As per the lawyer, the company tried to manipulate the definition of asbestos, despite internal documents from between 1978 and 1994 that showed asbestos fibers that were found in the tissue of the plaintiff are included.

Johnson &J’s highly uncertain $8.9 billion settlement deal hangs in the balance as we progression of this trial. Despite the distinctive nature of this mesothelioma-related case and its distinct issues compared to the majority of talcum powder lawsuits and a decision in favor of the plaintiff could cause a serious setback to J&J’s expectations of widespread acceptance of their proposed settlement among plaintiffs.

May 31, 2023: Update from Johnson and Johnson’s bankrupt talc business vigorously defended their 2nd Chapter 11 filing in the face of challenges from talc injury claimants. In a written objection to the New Jersey bankruptcy court, it argued that the filing was fundamentally different from the earlier filing. It also emphasized the unprecedented commitment of $8.9 billion by J&J the largest settlement ever made in the history of a mass tort bankruptcy. Is Johnson and Johnson talc free. Not mentioned: how the size of the settlement implies that it is an equitable settlement. J&J also claimed that it received support from various plaintiffs’ law firms representing more than the 60,000 plaintiffs. It is difficult to confirm but likely incorrect.

May 24 2023 Update: As of Johnson and Johnson’s bankruptcy filing in 2021 filing, the first trial concerning its cosmetic talc items allegedly comprised of asbestos is set to start jury selection on Monday, California in Alameda County Superior Court, an historically reliable court for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure through J&J’s products, an allegation the company denies. The trial also involves six retailers accused of selling talc-containing products.

May 22, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are currently fighting over who should be chosen to fill the post of the future claims representative, which is vitally essential in resolving the claims involving talc. Is Johnson and Johnson talc free. Randi Ellis, a lawyer who frequently appears in MDLs across the country was appointed as the claims representative during the first bankruptcy. J&J’s defense group wants Ellis to be named to the position in the future, however lawyers representing the talc plaintiffs are protesting on the grounds that Ellis has an unrelated conflict of interest which should stop her from taking on that role again. The conflict stems from the fact that Ellis was apparently involved in drafting the controversially contesting second bankruptcy, which raises concerns about her ability to be neutral. In reality, the bankruptcy will be dismissed in the end.

May 17th, 2023 Update: The fake company J&J put together to settle the talc litigation bankruptcy has informed a New Jersey bankruptcy court that they had allocated $400 million to settle the claims made by states accusing the company of deceitful advertising regarding its talc products. Is Johnson and Johnson talc free. It’s a $8.5 billion settlement to cancer victims. It’s difficult to envision the scenario in which J&J could push these baby powder settlements through with these numbers. While J&J’s proposed $8.5 billion offer sounds like a huge sum at first, it does not look very appealing when you consider the math. This settlement proposal – by our rough calculations – would not provide victims with much more than $100,000 per case. It’s not enough.

May 15th, 2023, Update J&J is potentially facing a lawsuit brought by an advocacy group that represents cancer victims. Is Johnson and Johnson talc free. The group contends that J&J intentionally canceled an $61.5 billion fund-raising agreement that it had with its company subsidiary LTL Management LLC, to simulate financial distress and verify the unit’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of victims’ compensation rights. They intend to investigate J&J’s actions as a result of the denial of LTL’s first bankruptcy case.

May 10 2023 Update: Next week this week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy filing from J&J subsidiary LTL Management. In the meantime, the bankruptcy has issued an order that requires both parties to participate in a settlement mediation hoping that the global settlement can be brokered.

May 5th 2023 Update: The talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products cause cancer from asbestos exposure. Is Johnson and Johnson talc free. Over 2,700 people have sued the company and the company was spending $1 million a month for legal defense. The company’s latest $29 million verdict at the Supreme Court of South Carolina forced it to pursue bankruptcy protection, and arguing for a fair distribution of assets among talc claimants instead of being taken over by the receiver. Other talc suppliers have also filed for bankruptcy due to the litigation.

May 4, 2023 Update: U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart settlement discussions with lawyers who have rejected Johnson & Johnson’s $8.9 billion offer for settlement. At Trenton, New Jersey yesterday, the parties appeared in court to discuss the next steps to take in another bankruptcy proceeding and Judge Kaplan was pushing for more settlement discussions.

This is the best way to resolve the claims of J&J. A settlement for baby powder can be completed. Is Johnson and Johnson talc free. But it’ll need more money – more billions of dollars – coming from Johnson & Johnson.

Lawyers have a split opinion on whether to accept the proposal and not every client views this issue the same way their lawyer views it. Second bankruptcy cases are likely to be a failure with Judge Kaplan has scheduled a hearing in June to determine if she will dismiss the bankruptcy for the second time.

May 3 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) asked an order from they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation over talc products. The group representing the claimants submitted a motion on Tuesday requesting that the Third Circuit to consider their appeal and return the case the lower court with instructions for dismissing the bankruptcy. Is Johnson and Johnson talc free. They also asked that stoppage of tort litigation against J&J should be permitted to continue.
LTL applied for Chapter 11 protection once again after its bankruptcy filing was rejected by the Third Circuit earlier this year with an $8.9 billion settlement. The committee believes that the recent ruling allowing LTL’s 2nd Chapter 11 to continue, while also halting trials against J&J is a reason for immediate Third Circuit review. The US Trustee also requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J plans to file a reply in the appeals court saying that the filing is an “desperate and legally insufficient attempt” by a few of law firms with competing financial interests.
May 1st 2023 Update: A common question that people ask is how could plaintiffs and their attorneys turn down $8.9 billion. That’s of course an immense amount of money. But there are plenty of victims. Is Johnson and Johnson talc free. They are a great claims for plaintiffs. We were reminded of this last week in two talc trials which have resulted in huge verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with the verdict worth $18.1 million. The following month, a second mesothelioma talc case was brought to hearing at South Carolina and resulted in the verdict of $29 million for the plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc. which is one of the most prominent manufacturers of talc in U.S.
April 30th 2023 Update: When J&J initially attempted to pull the talcum powder lawsuit into bankruptcy, it was met with an offer to put aside $2 billion for settlements. It was a ridiculously small amount. None of the talc plaintiffs believed in it. However, this time, J&J has increased the offer to $8.9 If the talc plaintiffs agree to a bankruptcy settlement and they have the support of a substantial portion of the talc plaintiffs and their attorneys. Is Johnson and Johnson talc free. But with 75% of plaintiffs in the talc category, which is required for bankruptcy plan approval is a difficult road because of the number of lawyers who have vast inventories of baby powder lawsuits opposed towards the agreement.

What is the solution to this impasse? More billions.
April 25, 2023 update: Talc patients have sought a court order to disqualify their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is Johnson and Johnson talc free. The 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not a candidate to receive bankruptcy relief because it did not show financial distress.

The claimants contend that the 2nd Chapter 11 case is an fraud on the bankruptcy system and it’s being conducted in bad faith. J&J claims the bankruptcy settlement is backed by “significant support” from the firms that represent around 60,000 people who are claiming. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are not united over what they believe is an $8.9 billion deal.

April 21st, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that the company sold a baby powder that contained a chemical that causes cancer. Even though trials for the lawsuits involving talc are delayed for a minimum period of 60 days and new lawsuits are able to be filed and lawyers may begin to prepare their cases. Is Johnson and Johnson talc free. The judge expressed skepticism over J&J’s pathetic attempt to revive its plan with a second bankruptcy trial.

April 13, 2023 Update: major story is that there’s an $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer victims involved in MDL class action MDL collective action pledged to fight the settlement with talc claimants. Why? They feel it’s too little money for the those suffering from cancer who are 70,000. Is Johnson and Johnson talc free. These lawyers argue that J&J should seek a bigger settlement or pursue individual claims in the event that the latest bankruptcy is thrown out.

There is a different set of lawyers who are not part of the leadership in this class action. These lawyers have amassed tens of thousands of cases. This group wants to settle for what many argue is far less than what these victims deserve. Their argument appears to be two-fold. First, they argue that the settlement of around 100 million dollars on average per plaintiff – is fair.

It’s a difficult argument to argue. The second argument is more substance: the victims will not afford to wait any longer and need their money now.

April 12 2023 Update: People are asking how J&J is able to file for bankruptcy again. The answer is complex and confusing. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc lawsuits conclusively. It believes it can pay less if there is a bankruptcy element that creates pressure to negotiate a settlement. Is Johnson and Johnson talc free. Driving past more than 400 years in American history, the company argues that bankruptcy benefits everyone by dispersing settlement payments more evenly and effectively than trial courts, where litigants are awarded significant settlements while others get nothing.

The basic tenet in this 3rd Circuit decision was this is not a case of a profitable company making an entity to assume the legal liability and declare bankruptcy, which is what Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled it was not in financial difficulty because J&J promised unlimited funding.
This is why J&J did not hesitate to take advantage of the unlimited funding portion of the deal but did not pledge to offer unlimited funding for the litigation. J&J claims that its revised financing arrangements with its subsidiary address the concerns of the appellate court, while offering claim payment funds. In the hope that offering victims less money would solve the problem at hand.

Attorneys representing cancer victims who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt: victims’ lawyers call it the most significant “fraudulent transfer of assets in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. However, it’s a means to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.

April 10, 2023 update: Bloomberg offers an informative article on a new law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of settlements. J&J is now willing an offer of $8.9 billion to settle any lawsuits.

The involvement of the funders is made public due to an New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. This rule is intended to respond to the increasing calls for regulation of the litigation funders. J&J has more than 60,000 claims when you add up state and federal baby powder lawsuits. Third-party funding of mass tort cases is not without its pros and cons. But there is no question that we are seeing how third-party funding can level the playing field between people as well as large corporations in court.

April 4 2023 Update: It’s fun to watch the worm turning in this case. J&J suffered another setback this week when it was found that the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals an order granting bankruptcy before the U.S. Supreme Court. Automatic stays have halted hundreds of cases involving talcum powder and stopped the filing of new lawsuits ever since J&J started the controversial process to spin the talc liabilities off into a bankrupt subsidiary more than a year earlier. Is Johnson and Johnson talc free. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was revoked. J&J had hoped to have it stayed in place until an appeal to the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that of the Supreme Court is willing even to accept the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay having been in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL in the space of a year. Seven new talc cases were brought into the MDL in the last month increasing the number of cases pending to 37,522.

February 25 2023 Update This morning, a Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J talc products have cost the government in the many years.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the dangers of its talc product for many years, while tax dollars were spent on treating people who suffered injuries from exposure to the product. The suit comes just a few days after J&J’s loss to the 3rd Circuit Court of Appeals.

Is Johnson and Johnson talc free. J&J must begin making reasonable settlement proposals for victims in order the process of putting all this behind. This is a blemish on one of the world’s greatest businesses.

February 14 2023 Update: During the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
