Lawyers representing cancer victims who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole is not exempt by the victims’ lawyers, who call this the biggest “fraudulent transfer in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method to try and push the $8.9 billion settlement and keep pressure on plaintiffs.
