April 13th 2023 Update: The major story is that there’s an $8.9 billion over 25 years settlement offer. Lawyers representing cancer patients within MDL class action MDL collective action vowed to fight the settlement along with Talc claimants. Why? April 12 2023 Update: Some people are looking for ways J&J can go through bankruptcy once more. The answer is complicated and confusing. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. In other words, it believes it can pay less when there is a bankruptcy element that creates pressure for a settlement. Going back to 400 years of American time, the business asserts that bankruptcy benefits all parties by distributing settlements more fairly and effectively than trial courts where some litigants receive significant awards while others receive nothing.

Attorneys representing cancer patients who oppose the deal counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt attorneys representing the victims claim it the largest “fraudulent move of assets in United States history.”

Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way to push for this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023, Update Bloomberg has an interesting article about a new law within New Jersey that is shedding new light on litigation funding in the baby powder class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) on behalf of talc products.
