J&J’s proposed settlement with talc would pay $400 million to US state AGs. Is Talc A Bad Ingredient .

Johnson & Johnson (JNJ.N) has set the amount of $400 million for resolving U.S. state consumer protection actions as part of a broader $8.9 billion plan to settle allegations that it’s Baby Powder and other talc items cause cancer. Is talc a bad ingredient.

J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay for different types of cancer victims in an arrangement for bankruptcy. Is talc a bad ingredient. J&J has said that its talc products are safe and will not cause cancer. J&J is seeking a second time to resolve more than 38,000 lawsuits filed in bankruptcy and prevent new cases from being filed in the near future.
The bankruptcy plan of LTL would pay $400 million to a separate trust for claims made in state courts by attorneys general claiming that J&J did not comply with laws against unfair business practices in the State of New York as well as consumer protection laws, by deceiving consumers regarding the security of its talc-based products.

A number of states had already initiated consumer protection actions against J&J prior to the first bankruptcy filing stopped those investigations from taking place in 2021. Is talc a bad ingredient. New Mexico and Mississippi had already initiated suits against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas in LTL’s court documents.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy in a joint move with cancer victims and those affected by cancer and the U.S. Justice Department’s bankruptcy watchdog, who have argued that a successful business like J&J does not qualify for bankruptcy protections aimed at people with debt problems.
The company’s initial attempt to resolve the bankruptcy cases was dismissed after similar arguments. In the end, a U.S. appeals court determined it was not LTL had not been in “financial financial distress” and ineligible for bankruptcy protection. Is talc a bad ingredient. LTL made a new bankruptcy application in just two hours following the decision to dismiss, arguing that its second attempt was different in that there was less money available and had more support for the settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s new bankruptcy violates the state’s law enforcement authority by trying to unilaterally cap the liability of the company in state consumer protection actions.

Is Talc A Bad Ingredient

LTL’s new filings also included more information on how the company would assess and settle cancer claims should the bankruptcy plan be approved.

The highest payments under the settlement would be $500,000 for patients diagnosed with mesothelioma that is terminal before the age of 45, and $260,000 for people diagnosed with terminal ovarian cancer before age 45.

From there, the proposed settlement applies discounts depending on the kind and severity of cancer, the individual’s years of age, their history of the use of talc, and other aspects. Is talc a bad ingredient. For example an individual who was using talc products weekly, had an ancestral history of ovarian cancer and was diagnosed an ovarian cancer stage II at the age of 55 may qualify for a $21,125 payment under the plan.

Judge decides J&J and talc opponents discuss settlement negotiations.

After another round of hearings in Johnson & Johnson’s attempt to employ a Texas Two Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the firm and the people who opposed the plan to enter into negotiations to settle the matter, Bloomberg reports.

In its second bankruptcy effort for LTL Management, a subsidiary set up by J&J to settle claims – the company proposed a settlement of $8.9 billion. Is talc a bad ingredient. While a firm representing plaintiffs support the proposal, another group is against the settlement.

This week, the opposition group, known as”the Official Committee of Talc Claimants in the bankruptcy court, demanded to dismiss this case by argument that LTL cannot be regarded as in financial distress.

“The filing is an incredibly legal and ineffective attempt by a handful of law firms to stop claimants from voting on the resolution, which the vast and growing majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in a statement. Is talc a bad ingredient. “The law firms involved in these filings have interests in finance that clash with, differ from and are in opposition to the interests that their customers. We will be submitting a response an appeal to the appellate court.”

Is talc a bad ingredient. Clay Thompson, a lawyer for MRHFM who includes more than patients with mesothelioma who have sued J&J, said that the company’s second bankruptcy try failed.

“J&J issue press releases describing how fantastic its plan is while simultaneously insisting that the plan’s details, including what individuals with illnesses would receive,” Thompson said in the statement. “What does the company have to cover up?”

Kaplan has instructed the sides to devise a second restructuring plan, with the supervision by two mediators.

On February 20, 2022 Kaplan affirmed the ability of J&J’s recourse to Chapter 11 to hasten a settlement that would release J&J from the tens of thousands of claims regarding its talcum products.

However, in January of this year, a federal appeals court ruled against the verdict, ruling that the business could not be considered to be in “financial distress.”

When J&J’s attempt to challenge the U.S. Supreme Court was dismissed on April 1, J&J filed for its second bankruptcy two hours later. In response, Kaplan froze the lawsuits for 60 days to decide whether or not to accept to file for bankruptcy again.

J&J’s unstoppable profit engine sputters after $6.9B settlement charge for talc.

With the Two Chapter 11 attempts, J&J has bought 19 months during which the cases were suspended. Is talc a bad ingredient. The company wants claimants to accept their settlement. J&J will require 75% of the vote for the settlement to be approved.

In addition to the team of talc lawyers who panned the company’s bankruptcy play in the U.S. Trustee, the U.S. Trustee which is a division from the U.S. Department of Justice is also submitting an appeal to dismiss LTL’s second bankruptcy.

In a statement this week, U.S. trustee Andrew R. Vara wrote that the doors of the bankruptcy court are “open to honest, but naive debtors.” These doors “are not open to parties who do not have a legitimate bankruptcy purpose or that seek to use bankruptcy to delay or hinder their creditors.” Vara continued.

For its part, J&J maintains there is no proof conclusive that their products containing talc, such as the famous baby powder, can cause cancer. J&J has taken its products off of the market–first to be available in North America in 2020–and the remainder of the globe later this year.

J&J seeks to avoid the expense of going to trial. J&J has won the majority of cases that have been decided during trial, however, certain losses have been extremely punishing.
A highly publicized trial in Missouri ended in an $4.7 billion verdict against the drug company but was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine talc trials that are either being appealed or resolved. In 41 trials 32 of them ended in a win by J&J either through a mistrial or plaintiff verdict that was annulled upon appeal. Is talc a bad ingredient. Additionally, the company in 2020 moved to settle over 1,000 cases worth $110 million. Bloomberg announced at that time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc A Bad Ingredient

June 2 2023 Update: At the asbestos talc case in California yesterday, a couple of technical issues interrupted the opening statements made by defense attorneys. Is talc a bad ingredient. The jurors, attending from home on Zoom, did hear Johnson and Johnson’s lawyer express doubt about the 70s research claiming asbestos was present in their product, but the session abruptly ended.

The plaintiff could introduce an initial witness Arthur Langer. Langer explained that the existence of additional minerals along with talc is inevitable. He testified that his team informed J&J in 1971 of the presence of chrysotile asbestos within the talc of the company, but in less than 0.1 percent. He also uncovered more asbestos in 1976.

June 1, 2023 Update: Is talc a bad ingredient. A trial for the first time since J&J took the decision to disband its talc section and declaring bankruptcy is an important turning point for the ongoing litigation drama. Trial started on Monday in the harrowing case of a young 24 year-old plaintiff who was diagnosed with an extremely rare and aggressive form of mesothelioma last year, which both sides agree is a grave tragedy.

Opening statements laid bare huge differences between the sides’ narrative. The attorney for the plaintiff took aim at Johnson & Johnson, alleging that the company employed deceitful methods in their research practices as well as throughout the litigation procedure. In the words of attorney Johnson & Johnson tried to alter asbestos’ definition, in spite of internal documents from the year 1978 and 1994 indicating that asbestos fibers in the tissues of the plaintiff are part of.

Johnson & Johnson’s uncertain $8.9 billion settlement offer hangs in the balance with the progression of this trial. Despite the distinctive nature of this mesothelioma-related case and its distinct issues compared to the majority of talcum powder lawsuits, a verdict favoring the plaintiff could result in the company with a major setback in its hope of gaining broad acceptance for the settlement they have proposed among plaintiffs.

May 31 2023 Update: Johnson & Johnson’s bankrupt talc division strongly defended the second Chapter 11 filing in the facing challenges from talc injury claimants. In an opposition filed with the New Jersey bankruptcy court, the subsidiary argued that the filing differed fundamentally from the prior filing. The subsidiary emphasized the record-breaking commitment of $8.9 billion by J&J as the largest ever settlement in a mass tort bankruptcy case. Is talc a bad ingredient. It was not mentioned how this amount signifies that it’s an equitable settlement. J&J also claimed that it received support from a variety of plaintiffs’ law companies representing over 60,000 claimants. This is difficult to verify but it’s likely to be false.

May 24 2023 Update: Following Johnson & Johnson’s 2021 bankruptcy filing, the very first trial regarding the cosmetic talc products it claims to that contain asbestos is scheduled to begin jury selection on Monday, May 24, California at Alameda County Superior Court, which is a well-known location for plaintiffs. The plaintiff claims his mesothelioma is the result of asbestos exposure from J&J’s products which that the company is denying. The trial also involves six retailers accused of selling talc-containing products.

May 22nd, 2023 Update Lawyers in the 2nd J&J talc bankruptcy are now disputing who should be chosen to fill the post of the claims representative in the future, a role that is critically critical to resolving claims involving talc. Is talc a bad ingredient. Randi Ellis, a lawyer who frequently appears in MDLs all over the nation, was appointed as the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed in that position again, but lawyers for the talc plaintiffs are protesting to the claim that Ellis has a conflict of interest that would prevent her from assuming that position once more. The issue stems from the possibility that Ellis was believed to have been involved in drafting the controversially contested second bankruptcy, which raises concerns about her ability to be neutral. In reality, the bankruptcy will get dismissed anyway.

May 17, 2023 Update: The pretend company that J&J created for the talc bankruptcy told the New Jersey bankruptcy court that they have set aside $400 million to settle the claims of states that accuse J&J of misleading marketing regarding its talc products. Is talc a bad ingredient. That’s an $8.5 billion settlement for cancer patients. It is hard to imagine the scenario in which J&J will be able to push these settlements for babies given these numbers. While J&J’s proposed $8.5 billion offer may seem like a large sum initially, it may not look very appealing when you consider the math. This settlement offer based on our estimates – will not pay victims much more than $100,000 per instance. That’s not enough.

May 15 2023 update: J&J may be in the middle of a lawsuit by an advocacy group representing cancer victims. Is talc a bad ingredient. The group argues that J&J intentionally withdrew the $61.5 billion contract for funding with its subsidiary, LTL Management LLC, to simulate financial stress and verify the unit’s Chapter 11 bankruptcy filing. The group claims this decision is a fraud transfer of the rights of victims’ compensation. They will investigate J&J’s actions following of the denial of LTL’s first bankruptcy case.

May 10 2023 Update: Next week next week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to reject the second bankruptcy filing of J&J subsidiaries LTL Management. In the meantime, however this bankruptcy court has issued an order calling for both parties to take part in a settlement mediation hoping that the global settlement can be been reached.

May 5, 2023: Update on Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer through asbestos exposure. Is talc a bad ingredient. Over 2,700 individuals have sued the firm and it has been paying $1 million per month on legal defense. The company’s latest $29 million settlement that was handed down in South Carolina forced it to seek bankruptcy protection, arguing that assets should be distributed in an equitable manner among talc claimants instead of being taken over in the hands of the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of lawsuits.

May 4 2023 Update: U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to relaunch talks on settlement with lawyers who turned down the company’s $8.9 billion settlement offer. At Trenton, New Jersey yesterday the parties appeared before a judge to discuss next steps to take in another bankruptcy proceeding. Judge Kaplan has pushed for further settlement talks.

This is the way to resolve the claims of J&J. A baby powder settlement can be achieved. Is talc a bad ingredient. However, it will require more money, more billions of dollars – from Johnson & Johnson.

Lawyers are divided on whether to take the proposal or not and not every client views this issue the same way their lawyer does. This second case of bankruptcy is destined to be a failure with Judge Kaplan has set a date for a hearing in June to decide whether to close the case for the third time.

May 3, 2023 Update The group of cancer victims who are suing Johnson & Johnson (J&J) demanded for the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. The group representing claimants for talc has filed a motion this week, asking for the Third Circuit to consider their appeal and return the case before a court of lower jurisdiction with instructions to dismiss the bankruptcy. Is talc a bad ingredient. They also requested that the stoppage of tort litigation against J&J allow the litigation to continue.
LTL has filed for Chapter 11 protection once again after its first bankruptcy filing was rejected in the Third Circuit earlier this year with a $8.9 billion agreement. The committee believes that the recent decision allowing the second Chapter 11 to continue, and also stopping trials against J&J should be subject to an immediate Third Circuit review. The US Trustee also requested that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement in the appeals court, calling the request a “desperate and legally insufficient move” by a small number of law firms with competing financial interests.
May 1, 2023 Update: One frequently asked question is how plaintiffs and their attorneys turn around $8.9 billion. Of course, that’s an enormous amount of money. But there are plenty of victims. Is talc a bad ingredient. These are an excellent claims for plaintiffs. We were reminded recently in two talc trials which resulted in big verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to the verdict of $18.1 million. The following month, a second mesothelioma-related talc case went to the court within South Carolina and resulted in an award of $29 million for the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the top manufacturers of talc in U.S.
April 30 2023 Update: In the year 2023, when J&J initially tried to take the litigation over talcum powder into bankruptcy, they came with an offer to set aside $2 billion to settle the case. This was an absurdly low amount. There was no one among the talc victims who were in favor of it. This time, however, J&J has increased the offer to $8.9 If the talc plaintiffs agree to a bankruptcy settlement and they also have the support of a large part of the talc-related plaintiffs and their lawyers. Is talc a bad ingredient. But 75% of the plaintiffs of talc are required to approve bankruptcy plans is not an easy task because of the number of lawyers who have vast inventory of baby powder-related lawsuits, opposed to the settlement.

What is the solution to this impasse? More billions.
April 25, 2023, Update Talc plaintiffs have requested a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Is talc a bad ingredient. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief as it failed to show financial trouble.

The claimants contend that the third Chapter 11 case is an fraud on the bankruptcy system and that it’s being pursued in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant support” from the firms that represent around 60,000 people who are claiming. It’s safe to say that the plaintiffs’ attorneys and the victims are split over the $8.9 billion amount of settlement offered.

April 21st, 2023 Update: A bankruptcy judge ruled in favor of Johnson & Johnson must face new lawsuits alleging that the company sold baby powder that was contaminated and causing cancer. While trials in talc lawsuits are paused for a minimum period of 60 days and new lawsuits are able to be filed, and lawyers are able to begin preparing their cases. Is talc a bad ingredient. The judge expressed skepticism over J&J’s ridiculous effort to relaunch its strategy in the second bankruptcy case.

April 13th, 2023 Update: biggest story is that there’s an $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer victims in the MDL collective action vowed to challenge the settlement those who claim talc. Why? They believe it’s too little money for the those suffering from cancer who are 70,000. Is talc a bad ingredient. The lawyers say that J&J should seek a bigger settlement or pursue individual claims if the latest bankruptcy is thrown out.

However, there is a second group of lawyers that is not part of the leadership in that class action. The lawyers collectively have accumulated hundreds of thousands of cases. They want to settle today in what many believe to be lower than what the victims should be paid. The argument they make is twofold. They argue that the settlement – which amounts to an average of $100,000 per plaintiff is fair.

It’s a difficult argument to prove. The second argument is more teeth: victims can not afford to wait any longer and need to get their money right now.

April 12 2023 Update: People are seeking out how J&J could file for bankruptcy again. The answer is complicated and confusing. But let’s try to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc-related lawsuits definitively. It believes it can pay less should there be an element of bankruptcy that puts pressure for a settlement. Is talc a bad ingredient. Moving past 400 years of American history, the firm asserts that bankruptcy benefits all parties as it distributes settlements more fairly and efficiently than trial courts, where litigants are awarded significant settlements while others get nothing.

The main thrust in the 3rd Circuit decision was this is not a matter of one that makes a profit, but subsidiaries to meet the legal liability and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled that the entity was in financial distress due to the fact that J&J assured it of unlimited funding.
This is why J&J decided to go with the unlimited funding aspect of the agreement and didn’t promise that it would provide unlimited funds for the litigation. The company claims that its revised financing arrangements with its subsidiary address the appeals court’s concerns while still offering funds to pay claims. As if providing victims with less money will solve the overarching problem.

Lawyers representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole did not go unnoticed: victims’ lawyers call it the most significant “fraudulent deal ever in United States history.”

In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. However, it’s a means to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10, 2023 Update Bloomberg provides an insightful report on a brand new law in New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) over talc products in exchange for a percentage of any winnings. J&J is now willing that it will pay $8.9 billion in settlements for all lawsuits.

The funders’ involvement is public knowledge due to the New Jersey court rule requiring the release of certain details about funders outside the state. The law is designed to address the rising calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you combine federal and state child powder-related lawsuits. Third-party funding for mass tort lawsuits has both pros and cons. But there is no question that we are witnessing the ways that third-party funding can even the playing field between individuals and big corporations in the courtroom.

April 4 2023 Update: It is interesting to watch the worm turn in this lawsuit. J&J was hit again this week, when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy ruling in the U.S. Supreme Court. It has halted thousands of talcum cases and prevented new lawsuits from getting filed ever since J&J began the controversial plan to spin the talc liabilities off into a bankrupt company over one year in the past. Is talc a bad ingredient. When the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was removed. J&J had hoped to have it remain in effect until its SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that for the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now officially lifted, the very first new cases have been filed and transferred into the Talcum Powder class action MDL in just over a year. Seven new talc-related lawsuits were added to the MDL over the last month and brought the total number of cases in the pending process up to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that be the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J product containing talc has cost the government over the decades.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc product for decades while tax dollars were spent on treating people who suffered injuries from exposure to the chemicals. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Is talc a bad ingredient. J&J should begin to make reasonable settlements to victims to in putting this behind. This is a blemish on one of the greatest businesses.

February 14 2023 Update: At an earlier hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
