Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc lawsuits conclusively. It thinks it can get a lower rate in the event of a bankruptcy element that creates pressure for a settlement. Is talc asbestos free. Going back to more than 400 years in American history, the firm claims that bankruptcy benefits all parties because it distributes settlement payments more evenly and efficiently than trial courts, where some litigants receive significant payouts, while others are left with nothing.
The basic tenet of this 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming a subsidiary to take the legal burden and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. However, it also stated it was not in financial distress due to the fact that J&J offered unlimited financing.
This is why J&J decided to go with the unlimited funding portion of the agreement and didn’t promise to provide unlimited funding for cases. The company says that its new financing agreements with its subsidiary address the concerns of the appellate court, while offering claim payment funds. In the hope that offering victims lesser money could solve the problem at hand.
Attorneys representing cancer victims who do not agree with the agreement counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt: victims’ lawyers call it the most significant “fraudulent deal ever in United States history.”
Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10, 2023 update: Bloomberg is running an intriguing article about a new law that has been passed in New Jersey that is shedding new light on litigation funding in the Class action suit. J&J has now offered an offer of $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public information due to an New Jersey court rule requiring the release of certain details about funders outside the state. This rule is intended to tackle the growing demands for regulation of litigation funders. J&J faces over 60,000 claims when you include state and federal child powder-related lawsuits. Third-party funding in mass tort claims has pros and cons. However, there is no doubt that we are seeing the ways that third-party funding can even the playing field between individuals as well as large corporations in court.
April 4 2023 Update: It is interesting to watch the worm turning in this lawsuit. J&J took another hit this week, when the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals an order granting bankruptcy before the U.S. Supreme Court. Automatic stays have halted thousands of talcum powder cases and stopped the filing of new lawsuits ever since J&J began the controversial plan to spin talc-related liabilities off into a bankrupt subsidiary more than one year in the past. Seven new talc lawsuits have been joined to the MDL in the last month increasing the number of cases in the pending process up to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J product containing talc has cost the government over the years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc products for many years, while tax dollars were spent treating those injured by exposure to the products. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
