Attorneys representing cancer victims who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole did not go unnoticed: victims’ lawyers call it the largest “fraudulent deal ever in United States history.”

In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it’s a way to push for this $8.9 billion settlement to keep pressure on plaintiffs.
