May 1, 2023 Update: One common question that people ask is how plaintiffs and their attorneys turn on $8.9 billion. That’s of course an immense amount of money. But there are a lot of victims. April 25, 2023 Update: Talc Cancer victims have requested a judge to reject the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc in soap safe. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible for bankruptcy relief since it was unable to demonstrate financial difficulties.
The claimants contend that the second Chapter 11 case is an misuse of the bankruptcy system, and that it’s being pursued in bad good faith. J&J says the bankruptcy settlement receives “significant backing” from the firms that represent around 60,000 people who are claiming. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on this $8.9 billion amount of settlement offered.
April 21st, 2023 Update: A bankruptcy judge has decided in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. April 13th 2023 update: the biggest news is the $8.9 billion over 25 years settlement offer. Lawyers representing cancer patients in MDL class action MDL class action have vowed to fight the settlement alongside the talc claimants. Why? They believe it’s too little money for the 70,000 victims who have cancer. Talc in soap safe. The lawyers say that J&J should negotiate a bigger settlement or litigate individuals’ claims if the current bankruptcy is thrown out.
But there’s a separate group of lawyers outside of the leadership of the class action. The lawyers collectively have accumulated hundreds of thousands of cases. The group is seeking to settle now for what many argue is far less than what these victims deserve. Their argument is twofold. First, they argue that the settlement of around 100,000 dollars per plaintiff is fair.
This argument isn’t easy to present. The second argument is more teeth: victims can now not wait and they want the money immediately.
April 12 2023 Update: People are wondering if J&J is able to file for bankruptcy again. The answer is complicated and complicated. Let’s try to simplify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc-related lawsuits definitively. That is, it thinks it can get a lower rate should there be a bankruptcy component that applies pressure to negotiate a settlement. Talc in soap safe. In a quest to cover the 400-year span of American history, the firm claims that bankruptcy benefits all parties because it distributes settlements more equally and more efficiently than trial courts where some litigants receive significant awards while others receive nothing.
The basic tenet in the 3rd Circuit decision was this is not a case of a profitable company making subsidiaries to meet the legal burden and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. It also clarified it was not financially distress because J&J assured it of unlimited funding.
Thus, J&J jumped on the unlimited funding portion of the holding and didn’t make any promises that it would provide unlimited funds for cases. The company claims that its modified financing arrangements with its subsidiary will address appeals court’s concerns, while supplying funds for claim payments. As if providing victims with lower amounts of money would resolve the problem at hand.
Lawyers representing cancer patients who do not agree with the agreement counter this with what you conclude is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared: victims’ lawyers call it the largest “fraudulent move of assets in United States history.”
In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10, 2023 Update Bloomberg provides an insightful article on a new law in New Jersey that is shedding new light on litigation funding in the class action lawsuit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of winnings. J&J has now offered that it will pay $8.9 billion in settlements for all lawsuits.
The involvement of funders is publicly available because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to address the growing calls for regulation of the litigation funders. J&J has more than 60,000 claims when you include state and federal baby powder lawsuits. Third-party funding of mass tort cases has pros and pros and. But there is no question that we are witnessing how third-party financing can help level the playing field for individuals and big corporations in court.
April 4 2023 Update: It is pleasing to see the worm turning in this lawsuit. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals a bankruptcy ruling before the U.S. Supreme Court. Talc in soap safe. After the 3rd Circuit ruled that this bankruptcy was insufficient some months ago, the stay was revoked. J&J wanted to see it continued pending the SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to take up the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay having been fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in over one year. Seven new talc lawsuits have been included in the MDL in the last month increasing the number of pending cases up to 37,522.
February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that The U.S. Government Accountability Office (GAO) start an investigation into how much J&J product containing talc has cost the government over the years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc product for many years, while tax dollars were spent treating those injured by exposure to the products. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Talc in soap safe. J&J has to begin making reasonable settlement proposals to victims to getting this behind. It is a stain on one of the world’s greatest companies.
